Validity and observance of the legal requirements, especially
of 86, 86 a German Penal Code (StGB)

delivered only for purposes concerning the civic information, the defence of unconstitutional
and ant constitutional activities, the scientific and art historical research, the

and uniform research and that this complies with 86, 86a German Penal Code (StGB)

(2) With his order the purchaser binds himself legally to purchase these objects

transactions between Customer and OVERLORD 1944.

General Terms
Our website operates under standard international
copyright law, any use of our images by other parties without our prior written
permission is an infringement of our copyright and will result in legal action.
This includes use of our images for hard copy publication or any use on the World
Wide Web.
All presented objects are contemporary originals and are sold with a life-time
full money-back guarantee. Any item determined to be not authentic may be returned
for a total refund. Inspection time re condition etc is however 10 days.
All offers
and descriptions are to our bounden duty and knowledge, based on the many years
of experience of our staff. Unless stated otherwise in item description, all "props"
such as medals, badges, belt, caps etc are not included. OVERLORD 1944 does not
offer and sell copies and reproductions.
The office of OVERLORD 1944 is the place
for both parties where the contract is to be fulfilled. Court of Justice for both
parties is Barcelona, España, with no exception. Orders placed are executed chronologically.
Orders by telephone call and fax are accepted.
Swords, daggers, pointed or stabbing
weapons (de-activated weapons), will only be delivered to persons aged over 18 years.

Of special interest
are the following relevant sections of German Law. Please read this summary of section
§ 86, 86a:
"Items that are used for making propaganda for a party or group which
is classed as unconstitutional or forbidden, even if they act outside Germany, may
not be spread inside Germany. This applies for items made to propagate ideas that
correspond with the ideas of the "Third Reich". They might not be made, kept, imported
or exported. The punishment may be prison (up to three years) or a fine.
This does
not apply if those items are used in order to inform others, repel actions that
are aimed against the constitution, if they are used in art, science, research,
teaching, or to report about historical events or similar purposes.
If you use or
show symbols or signs used by parties or groups that can be classified as unconstitutional,
or if you manufacture, keep, export or import those, you may be punished (three
years imprisonment or fine). You may not use or spread items that display or contain
those signs or symbols, e.g. flags, insignia, uniforms (or parts of uniforms), mottos
and forms of greeting.
You may also not use or spread signs or symbols that look
similar to those. This does not apply if those items are used in order to inform
others, repel actions that are aimed against the constitution, if they are used
in art, science, research, teaching, or to report about historical events or similar
purposes"
Note these regulations are only legally binding in Germany. OVERLORD 1944
will however only sell military antiques under the same conditions as simplified
in these regulations.
Layaways
I am more than happy to work out a payment plan on
larger items, I understand that we all have a limited budget with which to work.
With that in mind, here are the guidelines for the LAYAWAY program at OVERLORD 1944.
1) In order for an item to fall into the category of a layaway, the purchase price
must be at least 400.00€
2) The length of the layaway depends on the price of the
item(s). This will serve as a basic guideline for the duration of a layaway:
a)
if the price of the item(s) is 400.00€ to 600.00€, the layaway time is up to 60
days;
b) from 600.00€ to 1,000.00€, the layaway time is up to 90 days;
c) from 1,000.00€
to 2,500.00€, the layaway time is up to 180 days;
d) from 2,500.00€to 4,000.00€,
the layaway time is up to 270 days; e) item(s) for more than 4,000.00€, the layaway
time is up to a year.
3) No interest can or will be charged on layaways.
4) If the
purchase includes multiple items, individual items will not be sent until the entire
layaway has been paid for.
5) The down payment for a layaway will represent 20%
of the purchase price. This down payment is non-refundable if the buyer does not
live up to his or her end of the agreement.
6) Return policy....Your satisfaction
is very important to me and originality is always guaranteed for lifetime. However,
if you elect to return an item that you have placed on layaway, I shall retain the
down payment as a processing and administrative payment, because I will need to
market the item over again.
7) all layaways are subject to approval.
Payments
All
prices on the site are in € (Euro).Payment is due 3 days after ordering, if nothing
else is agreed upon before placing the order. Failure to fulfil payment within this
time span frees Overlord1944 of all obligations. The articles are property
of Overlord1944 until the customer has paid it in full.
The minimum order
is 50€.
Methods of payment
Payment in Euros or U.S. Funds. We accept money orders,
bank checks, postal money orders, Western Union and bank Wire Transfers (in Euros
or U.S. Dolars) and the following credit cards: Master Card, VISA. We will also
take payments with Pay-Pal, here the customer must add the 4% fee Pay-Pal is charging
us
Please note, we can only accept credit cards from outside the CEE from established
customers unless the customer can furnish the names of two dealers within the United
States that they have dealt with in the past with whom we can check with to establish
credit reference.
Shipping
Purchaser pays all shipping costs. We ship mostly by
UPS or Fedex. When ordering an item, we will advise you of the total cost including
shipping insurance. Be sure to specify your choice of carrier. Overseas shipping-We
can use all the above listed methods of shipping. Please note that surface mail
to U.S.A. takes 6 to 8 weeks.
We do not take any responsibility for shipped ordnance,
in today’s world ordnance may be put aside or just destroyed in many countries,
we always ship ordnance registered, but if the customer have chosen not to fully
insure the parcel, we take no further responsibility
Shipment to domestic or European
buyers is generally performed by Spain Mail Service. Packing and handling charges
(CIF) excluded. Ordered items are regularly packed and insured (CIF) by OVERLORD
1944. When posted all risks, especially losses and quality decrease by accident
are to be accepted by the client. The delivery will be affected only by pre-payment.
In some special cases can delivery be made per invoice to well known business partners
but only according preceding agreement.
Due to our inability to adequately insure
packages to countries outside of the Spain, we cannot be responsible for loss or
damage. Therefore, the customer assumes all responsibility for the package once
it has left our office. This includes all customs fees and duty charges.
Sales Tax
Because we attend many shows and we're mandated to register as vendors, we must
collect taxes in SPAIN (16%). Please add applicable sales tax to your purchase total
if you reside in SPAIN.
Returns
All of our items are original (pre-1945) to the
period. We offer an unconditional money back guarantee regarding this principal.
Should you decide to return any merchandise for ANY REASON, it must be returned
within FIVE (5) days after you receive the order for a full refund (less shipping,
The buyer is responsible for all costs associated with shipping the item back to
OVERLORD 1944). All returned items must be received in the same condition which
they were sent. Tampering with the item, cleaning of edged weapons, disassembly
or removal of accoutrements will void the return policy.

Charge will be assessed on any items returned which were purchased using a credit
card.
that items may not be returned if they do not fit! Items are being sold as
collectibles and are not meant to be worn! Sizes that may be given are the ones
that are marked in the items themselves. They are only given as a reference and
may not be correct.
Buying Items
We are always interested in buying original items
or doing trades for them against items in stock. We have the following criteria.
1) The item must be real and authentic and produced in the period before May of
1945. Please do not waste my time or yours;
2) I need to purchase the item for resale
and therefore must pay a wholesale price;
3) I need to see the item before I pay
for it. Keeping these in mind, I am open to any and all items you might have for
sale. I am willing to travel to buy large numbers of items or entire collections.
A note on pricing:
Many of you have asked, with good reason, about whether I negotiate
on items that are listed on the website. In fact you have mentioned that some items
say 5-10% off or Reduced Price. I wanted to provide you with some insight (or should
I say "in-site") on my philosophy of pricing.
I try my best to price the items at
"Fair Market Value". As you are certainly aware these things don't "grow on trees"
so I have costs associated with purchasing these items. I work long and hard to
buy items you'd be proud to have on display in your collection. This has taken years
of developing a fine network of pickers who are out there beating the bush to find
me authentic pieces.
Of course, we have all the other costs associated with running
a competitive business in this day and age. So that you are aware of my feelings,
I want to let you know that I need to get the price listed on the site. If an item
sticks around for 60 days or more, I might decide to reduce the price by listing
the percent reduction/reduced price, but until I decide to do that I won't negotiate
a price.
